1. Who we are

Truepath Transport Pty Ltd (ABN 95 702 141 740) operates the website https://truepathtransport.site and provides freight and transport logistics services, including general freight cartage, palletised goods transport, timed deliveries and related logistics support across Perth and regional Western Australia.

2. Quotes and bookings

• All quotes provided by Truepath Transport Pty Ltd are valid for 14 days from the date of issue, unless otherwise stated in writing.
• Quotes are based on the information you provide about the freight, including weight, dimensions, pickup and delivery locations and any special handling requirements. If the actual freight differs materially from that information, the quoted price may be revised.
• A booking is confirmed only when we accept your instructions in writing or by email. We reserve the right to decline any booking, including where freight falls outside our service scope or availability.
• Bookings may be changed or cancelled by mutual agreement. Cancellation after a vehicle has been dispatched may attract a reasonable call-out fee to cover time and fuel.

3. Client obligations

• You must ensure that all goods tendered for transport are properly packed, labelled and suitable for carriage in the manner agreed.
• You must provide safe and lawful access to pickup and delivery points, including adequate loading facilities where required.
• You must accurately declare the nature, weight and volume of all goods. We do not accept dangerous, hazardous, illegal, perishable or otherwise prohibited goods unless expressly agreed in writing in advance.
• You warrant that you are the owner of the goods or are authorised by the owner to arrange their transport.

4. Payment terms

• Invoices are payable within 14 days of the invoice date, unless alternative arrangements are agreed in writing.
• Accepted payment methods will be shown on your invoice. Overdue amounts may attract interest and reasonable recovery costs as permitted by law.
• Prices are quoted in Australian dollars and are inclusive of GST where applicable.

5. Delivery times

Any delivery time we state is an estimate only. While we work hard to meet agreed schedules, times may be affected by traffic, weather, road conditions, access issues and matters beyond our reasonable control. Time is not of the essence in the carriage of goods unless expressly agreed in writing.

6. Liability and the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement.

To the fullest extent permitted by law, and except where the Australian Consumer Law applies to guarantees that cannot be excluded:

• our liability for any loss or damage arising from the transport of your goods is limited to the cost of re-performance of the service or the payment of the cost of having the service re-performed, at our election; and
• we are not liable for indirect or consequential loss, loss of profit, loss of business or loss of opportunity arising from the use of our services.

Where goods are lost or damaged in transit, please notify us as soon as practicable so we can investigate and, where appropriate, make good. Insurance arrangements for particular consignments can be discussed before booking.

7. Force majeure

Truepath Transport Pty Ltd is not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, road closures, industrial action, mechanical breakdown, accidents, government restrictions or other emergency situations.

8. Privacy

We respect your privacy and handle personal information in accordance with our Privacy Policy. Information collected through this website is used to provide quotes, manage bookings and communicate with you about our services.

9. Intellectual property

All content on this website, including text, layout and branding, is the property of Truepath Transport Pty Ltd or its licensors and may not be reproduced without written permission, except for fair personal or non-commercial use.

10. Governing law

These terms are governed by the laws of the State of Western Australia and the Commonwealth of Australia. Any dispute arising from these terms or our services will be resolved in the courts of Western Australia, subject to any applicable consumer dispute resolution rights.

11. Changes to these terms

We may update these Terms of Service from time to time. The current version will always be published on this page with the date of the latest revision shown above. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
